Suit Brought by Ultimate Blackjack Tour Against Game Show Network

The Ultimate Blackjack Tour (UBT), is a company that sets up events and offers entertainment. It is slated to offer a show with the same name to be aired on Saturday afternoons beginning the 16th of September. It has a deal with CBS Sports to run for two seasons. It is suing The Game Show (GSN) claiming the breach of what it terms an "implied contract.”
UBT filed its suit in Los Angeles Superior Court last Tuesday. The suit calls for a permanent injunction against GSN stopping its airing of the airing World Series of Blackjack in its present format, along with monetary damages.
The complaint states that UBT presented to GSN what it calls "elimination blackjack" in a distinctive TV format. This was carried out at a pair of meetings in 2005 and on a strictly confidential basis, where they asked GSN to become their partner on a television series.
The suit states that although GSN declined they "misappropriated" their ideas including them in their recurring World Series of Blackjack, which had before this been set up using only traditional blackjack rules. UBT is able to name in their suit distinct features of the most recent GSN series such as "knock-out" hands and additional concepts they claim were lifted from the UBT presentation.
In the format for elimination designed by UBT, derived from experience in both gaming and entertainment, there are several variations. Included are the use of secret bets and elimination rounds.
Included in the UBT suit are charges of unjust enrichment, unfair competition and breach of confidence.
GSN has no comments.
